The rules for using the site and the product, including the terms that apply to the product text program.
These Terms of Service (“Terms”) govern your use of https://apexcycleservice.net and the Apex product operated by Apex Cycle Service LLC. By using the site, you agree to these Terms. If you do not agree, do not use the site.
Acceptance
You must be able to form a binding contract to use the site. If you use the site on behalf of an organization, you represent that you are authorized to accept these Terms for it.
The service
Apex provides AI-assisted analysis of public filings, company announcements and historical market data. The site also describes the product and offers an optional product text-message program. The service is informational. It is not a brokerage, a trading system or an advisory service.
No investment advice
Apex is not a registered investment adviser. Nothing on the site or in any output is investment, legal, tax or accounting advice, and nothing is a recommendation to buy or sell any security. No fiduciary or advisory relationship is created by your use of the site. You are responsible for your own decisions. For advice about your situation, consult a licensed professional. Read the risk disclosure before relying on any output.
Accounts and subscriptions
If you create an account, provide accurate information and keep your credentials secure. You are responsible for activity under your account. Paid subscriptions, if offered, renew for the period shown at purchase until canceled; you can cancel from your account page or by emailing [email protected]. We may suspend or close an account for misuse, nonpayment or a violation of these Terms.
SMS Communications
Program. Apex Product Updates is a marketing and promotional text-message program operated by Apex Cycle Service LLC. You opt in on the updates page by entering your mobile number and checking the optional consent box. The box is unchecked by default, and consent is not a condition of purchase or of using the product.
Message types. Product feature announcements, workflow guides for reading public filings, new report-format releases, educational notes about public filings, and occasional product offers. We do not send individual securities, trade calls, target prices or performance claims through this program.
Frequency and rates. Message frequency varies. Message and data rates may apply. Consent is not a condition of purchase.
Opt out and help. Reply STOP, UNSUBSCRIBE or UNSUB at any time to opt out. Reply HELP for help. You will receive a confirmation message after an opt-out request and no further messages unless you opt in again. Carriers are not liable for delayed or undelivered messages. Supported carriers include major US carriers such as AT&T, Verizon and T-Mobile.
Privacy. We will not sell or share your mobile information with third parties for promotional or marketing purposes. See our Privacy Policy and SMS Terms for the full program terms and keyword list.
Third-party data
The service reads public filings, announcements and market data from third parties, including filing systems and data providers. We do not control those sources. They may be delayed, incomplete or wrong, and a company may restate a document after we have read it. A link to a third-party source is not an endorsement.
Intellectual property
The site design, our text and the generated outputs are owned by Apex Cycle Service LLC or its licensors. Public filings remain the property of their filers. You may read and share an output for personal, non-commercial use with attribution. Do not scrape the site, resell outputs, or present an output as advice.
Disclaimers
The site and all outputs are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted or error-free, or that an output is accurate, complete or current. Model output can contain errors. The methodology page lists the limitations we know.
Limitation of liability
To the maximum extent permitted by law, Apex Cycle Service LLC and its members, officers, employees and suppliers are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the site or reliance on an output. Nothing in these Terms limits liability that cannot be limited by law.
Changes and governing law
We may update these Terms. When we do, we will change the effective date at the top of this page. California law governs these Terms, without regard to conflict-of-laws rules. Disputes will be brought in the state or federal courts located in Tulare County, California.
